Terms and Conditions
1. Introduction
1.1 App. RecoEye is a mobile application (the “App”) operated by Central LG Technology Limited, a company registered in United Arab Emirates with its registered office at Unit GV06/L03/303, Level 3, Gate Village Building 06, Dubai International Financial Centre, United Arab Emirates (the “Company”).
1.2 Service Description. The App offers users access to real-time pricing information and market analytics for catalytic converters. The App operates on a subscription model, providing industry-specific insights and resources to subscribed users. Additionally, the App includes a free plan, which offers limited access to content and features. Users on the free plan may be shown advertisements while using the App.
1.3. Acceptance. By using the App, you agree to comply with these terms and accept them. These Terms and Conditions have been written in accordance with relevant laws to govern your use of the App and to protect Users’ rights, including privacy.
2. Account Registration
2.1 User Account. User account is defined as a private account of every User that has access with a phone number and one-time passwords (OTPs).
2.2 Account Creation. To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.3 Fraud Prohibition. Automated Account creation and/or use of a fake or fraudulent ID is prohibited.
2.4 Account Security. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2.5 Access Limitation. Users cannot sell, rent, share or transfer their access to the App.
3. Obligations and Responsibilities of the Company
3.1 Provision of Services. Company will use reasonable efforts to ensure the accuracy, reliability, and timeliness of the information provided through the App. However, the Company does not guarantee that the information will always be error-free or up-to-date.
3.2 Maintenance and Updates. Company is responsible for maintaining and updating the App to ensure its continued operation and to provide enhancements or new features as necessary. The Company reserves the right to modify or discontinue any part of the App at any time, with or without notice.
3.3 Security. Company is responsible for implementing appropriate security measures to protect user data and prevent unauthorized access, disclosure, alteration, or destruction of personal information. These measures include, but are not limited to, encryption, secure servers, and access controls.
3.4 Customer Support. Company will provide customer support to assist users with any issues or inquiries related to the App. Support will be available through the contact methods provided in the App, such as email or phone, during the Company’s designated support hours.
3.5 Compliance with Laws. Company is obligated to comply with all applicable laws and regulations, including those related to data protection, privacy, consumer rights, and electronic commerce.
3.6 Transparency and Communication. Company is responsible for providing clear and transparent communication to users regarding any changes to the App, these Terms and Conditions, or the Privacy Policy. Material changes will be communicated through the App or via email notifications.
3.7 Data Privacy and Confidentiality. Company is responsible for safeguarding the confidentiality of user data and ensuring that it is used only for the purposes outlined in the Privacy Policy.
3.8 Downtime Policy. Users acknowledge that the App may experience scheduled or unscheduled downtime for maintenance, system updates, or other necessary technical improvements. The Company will use reasonable efforts to minimize disruptions and notify users where feasible. If a user spends a token to reveal an item’s value and the price is unavailable due to a technical issue, the user will be eligible for a refund of the affected token. The Company will provide a mechanism for requesting such refunds within the App.
4. Subscription and Payments
4.1 Subscription Plans. The App offers a free plan and subscription plans that grant access to different levels of content and features. Subscription fees, details of the available plans, and one-time purchase products, such as the ability to order a set amount of credits, are provided within the App. Users on the free plan may have limited access to content and features, and may be shown advertisements.
4.2 Billing. By subscribing to a plan, you authorize us to charge the applicable subscription fees to the payment method you provide. All fees are non-refundable except as required by law or explicitly stated in these Terms.
4.3 Renewals. Subscriptions will automatically renew at the end of each billing cycle unless you cancel the subscription before the renewal date. You can manage and cancel your subscription through your account settings in the App.
4.4 Refunds. All one-time purchases, including credits and value tokens, are nonrefundable, except in cases where a token refund is explicitly granted due to technical unavailability of pricing data, as described in Section 3.8.
5. Use of the App
5.1 License. Subject to these Terms, Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal or internal business purposes.
5.2 Prohibited Uses. You agree not to:
Use the App for any illegal or unauthorized purpose.
Attempt to gain unauthorized access to the App or its related systems.
Use the App to transmit harmful or disruptive code, such as viruses or malware.
Copy, modify, distribute, or create derivative works of the App or its content.
5.3 Termination. We reserve the right to terminate or suspend your access to the App, with or without notice, for any violation of these Terms or if we believe you are engaged in fraudulent or illegal activities.
6. Intellectual Property
6.1 Ownership. All content, trademarks, service marks, trade names, logos, and intellectual property rights in the App are the property of Company or its licensors. No rights or licenses are granted to you other than as expressly set forth in these Terms.
6.2 Breach. You cannot scrap, reproduce, distribute, modify, adapt, retransmit or publish, even partially, any of the elements listed above without Company’s written approval. Any unauthorized reproduction or representation will be considered fraudulent. Violating this prohibition constitutes an infringement of intellectual property rights. The content owners reserve the right to pursue legal action. Likewise, Company holds the “database producers rights” associated with copyright and databases. 6.3 User Content. If you submit any content (e.g., feedback, comments) to the App, you grant Company a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute such content.
6.4 AI Feature Usage. By using the App’s AI feature, you agree that any images captured or uploaded for this purpose may be utilized by the Company to enhance and train our internal AI models. We ensure that all data will be anonymized, and no personally identifiable information will be associated with these images. Our company reserves the right to use these anonymized images in any manner that supports the improvement and development of our technology.
7. Disclaimer of Warranties
7.1 “As-Is” Basis: The App and its content are provided on an “as-is” and “as-available” basis, without warranties of any kind, either express or implied.
7.2 No Guarantee: We do not guarantee the accuracy, completeness, or timeliness of the information provided through the App, including pricing information and market analytics.
8. SMS Authentication.
The App uses SMS one-time passwords (OTPs) for authentication purposes. Please be aware that receiving OTPs via SMS may incur charges depending on your mobile carrier and your country of residence. These costs are outside of our control and are the responsibility of the user. By using the App, you acknowledge and accept any potential charges associated with receiving OTPs.
9. Limitation of Liability
9.1 Exclusion of Damages. To the maximum extent permitted by law, Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App.
9.2 Cap on Liability. In no event shall Company’s total liability to you for all damages exceed the amount you have paid to us in the past six (6) months.
9.3 Value Disclaimer & Liability. The Company does not guarantee that the values displayed within the App precisely reflect the real-time market price of catalytic converters or any other scrap metal valuation. The pricing data provided is based on the Company’s internal algorithms, external market sources, and other proprietary methods and may not always align with market fluctuations. Users acknowledge that the use of displayed values for financial decisions is at their own risk. The Company shall not be held liable for any financial losses, missed sales opportunities, or business decisions based on the displayed pricing information.
10. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and disclose your personal information. By using the App, you agree to the terms of the Privacy Policy.
11. Changes to Terms and Conditions
We may update these Terms from time to time at our discretion. We will notify you of any material changes by posting the new Terms within the App or by sending you an email notification. Your continued use of the App after any changes to the Terms indicates your acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law. These Terms shall be construed and governed in accordance with the applicable laws, without regard to its conflict of law principles.
12.2 Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If such negotiations fail, the disputes shall be submitted to the competent courts.
13. Exclusion.
Company reserves the right to revoke a User’s access to the App at any time, without providing any reason or justification. Once an account is terminated, it is permanently deleted. The User will no longer have access to their account or be able to use the App’s services. Since the account is deleted, any data entered by the User will no longer be accessible or communicated.
